This Privacy Policy (“Policy”) explains how Fancall Private Limited, a company incorporated under the Companies Act, 2013, having its registered office in India (“Fancall”, “Company”, “we”, “us”, “our”), collects, receives, stores, processes, uses, shares, and protects personal data in connection with your use of the Fancall mobile application available on iOS and Android platforms (the “Platform”).
This Policy applies to all individuals and entities using the Platform, including Fans, Creators, and Brands.
By downloading, accessing, registering on, or using the Platform, you acknowledge that you have read, understood, and consent to the practices described in this Policy. If you do not agree, you must not use the Platform.
2. DEFINITIONS AND INTERPRETATION
For the purposes of this Policy:
- “Personal Data” means any data about an individual who is identifiable by or in relation to such data.
- “Sensitive Personal Data” includes financial information, authentication data, call recordings, audio or video content, and any data designated as sensitive under applicable law.
- “Processing” includes collection, recording, storage, structuring, use, disclosure, transfer, retention, deletion, or destruction of data.
- “Data Subject” means the individual to whom the Personal Data relates.
- “OAuth authentication” means authentication through third-party platforms such as Google, Apple, Instagram, or YouTube.
Any reference to “including” or “for example” is illustrative and does not limit the scope of the related statement.
3. DATA PROCESSING PRINCIPLES
Fancall processes Personal Data in accordance with the following principles:
- Lawfulness and fairness
- Purpose limitation
- Data minimisation
- Accuracy and integrity
- Storage limitation
- Confidentiality and security
Personal Data is processed only to the extent necessary for clearly defined and lawful purposes.
4. CATEGORIES OF PERSONAL DATA COLLECTED
4.1 Identity and Contact Information
We may collect:
- Full name
- Mobile number
- Email address
- Profile photograph (if uploaded)
4.2 Account and Role Information
We may collect:
- User role (Fan, Creator, Brand)
- Account identifiers
- Username or display name
- Registration date
- Login and logout timestamps
- Role-based permissions and activity logs
4.3 Authentication and Verification Data
When you authenticate using third-party services (Google, Apple, Instagram, YouTube), Fancall may receive:
- Basic profile information
- Public identifiers
- Verification signals
Fancall does not receive, access, or store passwords of any third-party accounts.
4.4 Wallet, Transaction, and Financial Data
We may collect:
- Wallet balance and transaction history
- Amounts paid and received
- Transaction timestamps
- GST and tax-related records
- Payment status and identifiers
Fancall does not store debit card numbers, credit card numbers, UPI IDs, CVV, or banking credentials. Payments are processed through authorised payment partners.
4.5 Call Data and Recordings
Fancall records all audio and video calls conducted through the Platform.
Call data includes:
- Audio and video streams
- Call duration
- Call start and end timestamps
- Participant identifiers
- Technical metadata associated with calls
Call recordings are treated as Sensitive Personal Data.
4.6 Fan Moments
We may collect:
- Fan Moments captured by Fans
- Metadata linking Fan Moments to the Fan’s account
- Storage references required to provide the feature
Fan Moments are:
- captured by the Fan
- stored by Fancall
- visible only to the Fan within the Platform
- shareable externally by the Fan at the Fan’s discretion
4.7 Device, Technical, and Usage Data
We may collect:
- Device identifiers
- IP address
- Operating system and version
- App version
- Crash logs
- Performance and diagnostic data
4.8 Communication, Support, and Safety Data
We may collect:
- Support tickets
- Reports and complaints
- Communications with Fancall teams
- Investigation, moderation, and enforcement records
5. PURPOSES AND LEGAL BASIS FOR PROCESSING
Fancall processes Personal Data only for the following purposes:
5.1 Platform Operation and Contractual Performance
- Creating and managing user accounts
- Enabling audio and video calls
- Facilitating Wallet transactions
- Providing Fan Moments functionality
- Enabling Brand–Creator discovery, communication, and payments
5.2 Safety, Moderation, and Compliance
- Monitoring and reviewing call recordings
- Investigating complaints, misconduct, fraud, and abuse
- Enforcing Terms and Conditions and Platform policies
- Protecting users and the integrity of the Platform
5.3 Analytics and Product Improvement
- Understanding usage patterns
- Improving features, reliability, and performance
- Debugging and system optimisation
5.4 Legal and Regulatory Compliance
- Complying with applicable laws
- Responding to lawful requests from competent authorities
- Maintaining audit trails and records required for compliance
6. CALL RECORDINGS AND INTERNAL ACCESS CONTROL
6.1 Recording Consent
By creating an account and by initiating or receiving calls on the Platform, you provide explicit and informed consent to the recording of audio and video calls.
6.2 Access Restrictions
Access to call recordings is strictly limited to:
- Moderation team
- Product and analytics team
Access is:
- role-based
- logged
- restricted to a need-to-know basis
6.3 External Disclosure
Call recordings are not:
- shared with other users
- shared with Brands
- published publicly
- used for advertising, promotion, or marketing
6.4 Retention of Recordings
Call recordings are retained until account deletion, unless retention is required or permitted by applicable law or necessary for enforcement.
Retention and disclosure may occur where required by:
- the Information Technology Act, 2000 and rules made thereunder
- the Digital Personal Data Protection Act, 2023, as applicable
- lawful notices, directions, or orders issued by a court or competent authority
- dispute resolution, fraud prevention, investigations, audits, or legal proceedings
Fancall does not commercially exploit call recordings.
7. THIRD-PARTY AUTHENTICATION AND PLATFORM POLICIES
If you use OAuth authentication or connect third-party accounts, your use of those services is governed by their respective terms and policies, including but not limited to:

Fancall does not control third-party services and is not responsible for their privacy practices.
8. DATA SHARING AND DISCLOSURE
Fancall may share Personal Data only in the following limited circumstances:
8.1 Service Providers
With vetted service providers for:
- payment processing
- cloud hosting and storage
- analytics and monitoring
- customer support
Such providers are bound by confidentiality and data protection obligations and may process data only as necessary to provide services to Fancall.
8.2 Legal and Regulatory Authorities
Where disclosure is required by:
- applicable law
- court order
- lawful request by a competent authority
8.3 Corporate Transactions
In the event of a merger, acquisition, restructuring, or sale of assets, Personal Data may be transferred subject to appropriate confidentiality and security safeguards.

No system is completely secure, and Fancall cannot guarantee absolute security of Personal Data.
10. DATA RETENTION AND DELETION
Personal Data is retained only for as long as necessary to:
- provide the Platform and Services
- comply with legal obligations
- resolve disputes
- prevent fraud
- enforce rights and Platform rules
Upon account deletion:
- Personal Data is deleted or anonymised to the extent feasible; and
- certain records may be retained for legal compliance, audits, dispute resolution, fraud prevention, and enforcement.
11. USER RIGHTS AND CHOICES
Subject to applicable law and verification requirements, you may:
- access and correct Personal Data
- request deletion of your account
- withdraw optional permissions
- raise privacy-related concerns
Certain data may be retained where required by law.
12. CHILD AND TEEN PRIVACY
- The Platform is not intended for individuals under 12 years of age.
- If a User is under 18, the User must have valid parent or legal guardian consent to use the Platform and make payments.
- Fancall may suspend or terminate accounts where these conditions are not met.
13. THIRD-PARTY LINKS
The Platform may contain links to third-party websites or services. Fancall is not responsible for the privacy practices of such third parties.
14. CHANGES TO THIS POLICY
Fancall may update this Policy from time to time. Updates become effective upon publication. Continued use of the Platform constitutes acceptance of the updated Policy.
15. GOVERNING LAW AND JURISDICTION
This Policy is governed by the laws of India. Courts located in India shall have jurisdiction, subject to any arbitration clause in the Terms.
